On October 22, 2009, Paul Martin Conway appeared before the Supreme Court of Canada. Mr Conway has been detained in custody for over 26 years in the forensic mental health system. He seeks through his appeal direct access to the Canadian Charter of Rights and Freedoms which is presently denied to him. In short, this case is about whether the Ontario Review Board is a court of competent jurisdiction so as to grant a remedy under section 24(1) of the Charter. I was counsel at the hearing at first instance and had the pleasure of accompanying him to court last week to hear the case argued.
